The only thing I can find, which even remotely restricts anything is this blurb:

Current federal law requires dealers to report to ATF any "multiple sales" of two or more handguns that occur within five consecutive business days.

Other than that, and that isn't really a "restriction", there is no federal restriction as to the number of legal firearms a private citizen may purchase, if he is not prohibited from buying such firearms legally.

Yep.. I know.. but felt like voicing it.. and yes.. there should be an inconvienience fee that they should pay for interdicting a citizens rights.

I've never heard of such a law. It seems there'd have to be some kind of law on the books driving such a letter. I've been all over the BATFE's website and have never seen anything stating anything relative to the number of firearms one can purchase. If someone knows of this law/rule/etc., please put up a link. I'd like to send out the link to a lot of buddies.

I know there is a record of multiple purchase that a licensee has to fill out if he sells multiple guns to a non licensee during a month.. etc.

Nope, the BATFE will never call or send a letter to anyone telling them they have to be an FFL. I know only too well that the intentionally got rid of tens of thousands of little FFL license holders in the last 20 years. One requirement for a current FFL license is to have commercial property for the retail sales of the firearms. Needless to say, the BATFE isn't going to tell anyone they need to "upgrade" to an FFL license; just the opposite is true.

They definitely sent this guy a letter I had a copy of it, me and my brother had a laugh over it because like I said this guy was always bucking heads with authority.
EDIT: This was 6+ years ago, now remember I had copies of correspondence between town and ATF where they indicated their stand on the matter, these were public record as they were part of a zoning dispute. I did not have a copy of direct correspondence between ATF and neighbor, we got along fine but he would not have shared that with me. It was the end of his selling firearms, I know that for sure.

I think it was exactly what you mentioned that because he did not have an actual commercial establishment he could not sell more than x number of guns per ? period of time, even though he was not advertising or any of that, he was transferring enough that they said he was a de facto dealer.

I think (almost positive) this guy had an FFL before the stricter requirements, so it was not about him upgrading to FFL, it was that he could not meet the new standards, that's why he got the cease and desist.

I guess this does not apply to OP since now we're just talking about selling guns and his issue was purchasing. Maybe there is no defined restriction on the number of purchases, but who among us would ever believe that at some point "THEY" are not gonna take notice and at least take a second look, which could cause a delay???

JB4310, I don't doubt the letter and yes, it sounds like the ATF shut him down because he couldn't succumb to the new federal FFL laws. I know several guys who are "grandfathered" in because they've had their FFL's for 15-20 years and they operate rurally on their private property, albeit in a separate building from their residence.

It all makes sense now. Thanks for clarifying...whew, you had me worried. The delay I received was nothing more than caller volume backup.

Not to get all paranoid about this or anything, but since some agency has to approve your purchase of a gun, or at least is asked to check that you are not disqualified to purchase a gun, and since everything of this nature is now handled on computers, and because computer memory is now so incredibly huge, and on account of government agencies are in the business of keeping track of all kinds of data about us......why would you not assume that somewhere there is a fairly complete record of how many guns you have purchased where you were required to have such a check made? Do they promise not to keep such records? Given such a record, why would some bureaucrat not eventually get around to running a little program to count how many guns had been legally purchased by each individual on the list? This sounds exactly like the kind of thing the Department of Homeland Security might be interested in. All rights, not just gun rights, are subject to government tampering.

Yes.. the nics data is not suposed to be maintained past a certain time limit.. however it has already been found out that some agencies have tried to stock pile it.

In any case.. if yuo fille dout a 4473.. that record is permanent in the FFL's files, and when he goes out of business he has to send his files tot he ATF.. so yeah.. in the thick of itall.. there is a paper trail.. and trace data can eventually be used to determine some things.. be it ffl to ffl bound book xfers.. or end user 4473 / special form purchase / registration.. etc.

Sounds like you need to take your wife shooting, small sutff first of course. I got my wife hooked and she doesn't mind my purchases any more. She has a few of her own. When I first started re-loading, she was concerned about having powder in the basement but she eventually got over it.

On another note.. i see that the ATF is now distributing the firearms publications via PDF file on cdroms... just got mine today.

( Alcohol tobacco and firearms.. that should be a store.. not a government agency! )
