TSC - buyer beware...

I spent considerable time researching manure spreaders, selected the one I wanted, Loyal, and then spent
more time shopping best price. I checked locally, $1600 and finally ordered from TSC at $1200 plus $180 shipping over the phone. I was very explicit over the phone after talking to the manufacturer I knew exactly what I wanted and what to ask for. I was quite surprised when it arrived wednesday. It was red not galvanized, it said Fimco not Loyal. A call to TSC, "Oh yes we changed manufacturers but it's made to the same specs, same gauge, same wheel size everything.

Well excuse me we've all heard that before at one time or another... I checked the specs, there's enough differences to kinda piss me off and off course material is only one of the ingredients to a quality product one of the others being workmanship. So it's off to the local dealer (the $1600 guy) check out the real loyal and possibly eat crow.... It's not all bad there are at least 2 features of the Fimco that I like better, but I have my doubts as to how well it will hold up as there is just too many cost cutting differences in this Fimco product. Anybody have a Fimco manure spreader??

I'm sure you'll find the TSC catalogues and website have a disclaimer stating that items "may not appear as shown in the {catalogue or website}" and the items mays be substituted if meeting the same requirements and value.
Words to that effect, anyway...

However, no doubt you'll get your money back.

yeah I know and that would be fine if they matched the specs but like I said there's enough differences to make
quite an overall difference. Of course I did save $200 but I would rather have the quality and longevity than
a few more bucks in my pocket. sure they'll probably refund my money but minus the shipping costs $180 each way.
Ah well live and learn and never stop asking questions. :^)

They should refund all of your money and the shipping costs are their obligation. If they had delivered what you ordered, it would be a completed sale. Since they substituted another product without your approval, you are under no legal obligation to accept it. If they don't refund the entire amount, then I would suggest a call to your State's Attorney General office of Consumer Protection. With one call to them the problem will be resolved. You don't have to accept their substitution unless it was of like kind and quality. Since this is completely different in materials and construction, the mistake is theirs to live with, not yours. Just my 2 cents..... The Junkman...

This must be a small mistake of a person owned by TSC.
They are not a small company or millions of dollars company who is in the business for a decade or two who will steal your a few hundreds of dollars. They are "billion" dollar company, in the business for 65! yearss, with more than 6000 employee. They will pay even your phone call cost and your $200. No?

I agree with the others.. and also, I hope you payed for it via credit card.. though preferably not theirs. If you paid by a regualr credit card.. say MC/vise/discover, etc.. you have very specific legal rights. Even if their website says equivalent substitutuions can be made.. I'd wager that if you were not informed that the product was going to arive 'not as ordered' and there are -any- points of difference , including mat'ls and workmanship.. I'm guessing your credit card company will force them to work with you.. or they can pony up and eat the sale altogether.

No way I'd settle for having to pay the $180. If you paid with credit card you can dispute it and likely get TSC to pay it. If you specifically asked for the Loyal brand I wouldn't care what the disclaimer said. You didn't get what you asked for.
