For it to be mandantory, it must be "mandated" by some entity. OSHA comes to mind first, but that would only apply where an employee is involved I'm guessing.
Insurance could be another to mandate it but I've never heard of that.
I vote for "voluntary".

On tractors it is mandatory I believe. In other words if it has a 3-point hitch. However, even that can get a little blury because for instance there are "lawn mowers" that can be fitted with a 3-point hitch. There are no laws regarding lawn mowers or zero turn mowers as pertains to ROPS. In fact there are some VERY large name lawn mower companies in court right now because of their use of roll bars.

I think you need to clarify your question.
If you mean "do all new tractors sold have to have a ROPS?", then the answer is likely yes. If you mean "will I get in trouble if I don't use my ROPS, or take it off?" the answer is likely NO as long as you are operating it. Hire some kid to run it, or sell the unit after you've taken the ROPS off, then you are likely subjecting yourself to liability.

If my tax money has to pay for your extended nursing home care once your insurance runs out(if you even had any to begin with), I'd say mandatory. If not, then go for it and hope mankind has a big enough heart to take care of you.
O.K. that sounds harsh. Accidents happen and some are preventable, but people have to live and can't be in a bubble all the time. The question shouldn't be "mandatory or voluntary". It should be "Why are people compelled to not use safety equipment that is proven to work, and should society bear the monetary and emotional costs of dealing with people that don't use it by choice?"

On a NEW tractor the manufacturer/importer MUST equip the tractor with a ROPS if the tractor is larger than a garden tractor. (basically everything from a SUB-Cut and larger, that is sold new, must have a ROPS or certified Cab installed) MANDATORY.
However some people remove those factory installed ROPS and for PERSONAL use that is legal. Stupid, but legal. VOLUNTARY.
For COMMERCIAL use, any tractor that WAS ORIGINALLY EQUIPPED with a ROPS or certified cab structure MUST be operated with the ROPS installed and upright according to OSHA regulations. So for commercial purposes it is illegal to remove or defeat it (which means that folding ROPS must be locked in the upright position during use, using factory spec bolts, pins, etc. MANDATORY.
