Im sure some of you have heard about this class action lawsuit. It was published widely and shown on the news when it was settled in june i think. Anyway you can go to this website and find out if your mower is included and sumit your info and receive a $75 each rider and $35 for each push mower.

Im sure this is posed here but if not here it is. Claims must be in by 8/31/10.

The mowers covered go back to 1994 from most major brands.

This has been covered by the news so i know this is no scam. Maybe i posted a scam page ? whoknows? Really though the settlement and $75 is no scam.

Thanks for posting.

I filed today. The settlement will almost pay for the replacement fuel pump for my JD LX279.

Anyone actually rec'd a $75 check yet?

A scam as the lawyers will take most of the money, and the customers will pay for the settlement in higher priced mowers. You (we all) will pay in the end, and the lawyers will sit back and take the $$$ to the bank.

I won't participate.

"The lawsuit claims that the Defendants sold certain gasoline-powered lawn mowers and lawn mower engines with false and misleading horsepower ratings. The Defendants deny these claims and deny that they did anything wrong. The lawsuit does not concern the safety of these lawn mowers. The parties have agreed to resolve this case by settlement."

For those that have filed or are planning to file, how did the "false and misleading horsepower ratings" effect you ?

The manufacturers need to publish accurate figures. How else can we make our buying decisions?

As I am a fan of smaller government I prefer this litigation as a method of forcing honesty from the manufacturers to the FTC stepping in.

yea you did not have all the facts when you bought. Say you were looking at a JD and a HUsky at lowes. The JD was $1300 and had (so it said) 23 hp, the husky was $1200 but had 25 hp (so it said). At that time you really wanted a JD but also money was very tight and that $100 saved could have gone to a beter place, granted they all cut grass. Another scenario similar could be that they both were the same price yet the Husky claime 25 hp and the JD 23hp.

Both these mowers were probably around the same power, but husky just inflated their #'s to look better over the competion (these brands are 2 that i picked out of my head not necisarily saying either is guilty or did this).
They may have really put out that power using racing fuel and reved up much higher than working rpms, a level that would not be sustiainable if you wanted your mower to last more than a few hours. So in my opinion they may put that power out but not under real world situations.

Point is you picked the bigger one if not really brand loyal under the assumption that it had more power and would cut the thick stuff with out bogging as bad. Think about it we always think bigger is better.

Man, you hit the nail on the head. I could not agree with you more. I think many people will eventually get their money, but it is the lawyers that will cash in big time for their "hard work." I also would not participate in this as a matter of principle.

Yea, nothing is finalized yet, and I doubt it will be unless the lawyers can get enough owners together for it to be profitable for them. I don't like the idea of filing a lawsuit for things that are generally common knowledge, and have been exposed in print for years like these HP claims. I won't participate for sure.

I received a notice in the mail 9 months or so ago for a Craftsman push mower with a Honda engine so it's not a scam. I guess if you sent the warranty card in, they have a record of who bought one of the brands participating in the settlement.

I did send it in but always throw out those class action suit offers which usually come out to a few dollars at most - not worth the bother and I'm not sympathetic to the cause in most cases. Still, somebody else will get your share if you don't particiapte.

In this case, $35 seemed a bit more than trivial and it was easy to register. That said, I never felt snookered by any advertisement. I realize most of these hp ratings are inflated. It's no wonder now about all I see for ratings is cc displacement. Removing hp claims avoids the issue altogether. Less information for the consumer seems to be the end result of this litigation. The time for tort reform is well overdue.

Oh, ani't seen my $35 yet. Forgot all about it until I saw this thread.
