HST repair again?

Have a L4240 HSTC with 1300 hours;one year ago, it developed the dreaded HST leak(bad seal) in transmission.Had it repaired(tractor must be split by the local dealer)six weeks down.Used it yesterday and appears it's gone again;small leak about a drop a minute.
I have only put about 75 hours on it since the repair.Should the dealer be responsible?Big money fix about $2k.
