We live in a rural area and about a mile away is a park that has three ball fields and a small golf coarse. The park is run by the local Lions club we enjoy walking over to it with our Labrador retriever next to it is an old railroad right of way which we walk also. The golf coarse used to be a five hole and recently upgraded it to a nine hole coarse so they had to squeeze some of the holes in for lack of space.

So the other day I am driving home from work and as I am passing by the park with my new, less than 5000 miles pickup, I hear a bang on the truck. Knowing immediately what the sound had to be I pulled over and sure enough a golf ball put a dent in the side of the truck. I turned around and drove into the park 3 young people were golfing. I asked if they had hit the ball that hit my truck and one young man said yes it was his. I didn't know how to handle it so got his name and phone number and also called the sheriff department because this was a new one for me, they said I needed to talk to someone from the golf coarse.

I called someone from the Lions club they informed they never heard of this before but would contact another member that should. He called me back later saying it sounded like it would go under the Lions insurance that I should contact my insurance and they would go after their insurance. I contacted my insurance and was told to get estimates which came to over $1200.00 and give it to the Lions member. Turns out the Lions member is a lawyer we called him numerous times finally he returned the call and left a message to drop the estimate off at his office but he didn't know what they were going to do with it.

I dropped it off and asked to speak with him as I didn't know what he meant by that statement and of coarse he was with someone the girl at the desk asked if it was about the truck and said she would give it to him. Never got a reply after dropping it off so called and asked to speak with him and it sounded like I could and then oh no he is with someone I told her to have him call but nothing. Talked to my insurance they said he would not return their call either. Insurance said they would fix it but I would have to pay my $250 deductible. My question is what do you think I should do I hate confrontations and the Lions do a lot for the area? Two things really irk me, one is no call back and the other is the hole that I was hit by is hole number 7 which is right next to the road, it is a short hole and you have to hit right toward the road to play it.

In the grand scheme of things a small claim to repair your truck should not be a big deal. I would push it personally. Thankfully the ball just did property damage (sorry don't mean to minimize your damage) and didn't hit a person/child/etc that was walking by. Sounds like you "found" a problem that the Lions need to deal with to prevent a personal injury or additional property damage in the future.

Yep.....had one hit my truck driving by the public course here. Ball was perpendicular to the fairway....talk about a slice !

Personally I'd pay the deductible and let my collision insurance fix the truck. That way your insurance company's lawyer can deal with the Lion's club and you're out of it. When your insurance company collects on the claim they should refund your $250. The sheriff or the county should be able to require the Lions to put some type of fence between the hole and the highway. Next time they may not be so lucky. You can't shoot a firearm toward a road. Is firing a golf ball that much safer?

I'm guessing the golf course itself is not at fault, the person that hit the ball is the at-fault party. Give that person's name to your insurance company and they can go after that person after they pay to have your truck repaired.

II had something like that happen and I gave the info to my insurance and they settled with the other guys company. My thought is talk to your company and have them take the lawyer out of the mix. They can go around him or at least mine did and deal between insurance companies. I recall the word subrogation?

I had a piece of industrial machinery hit my pickup. It was part of a very large U-joint on a big exploration drilling rig. It hit tough going and the U-joint exploded. I got the name of the drilling companies insurance carrier - gave it to my insurance company - the truck was repaired. No claim was ever filed against my policy.

Thankfully - no attorneys were ever involved.

Actually the golf course is at fault if it sets up a hole that forces player to hit towards the road. They need to place a fence up to protect people. Next time, the accident may be more serious.

I would pay the deductible and let my insurance company handle it any way they wish. No need for you to waste your time chasing down to put out subpoenas, filing small claims court costs, and more importantly - your time. Clearly you're not at fault and determining who is is a matter for the insurance company. That's what its for... Bottom line though is that I would NOT 'just let it go'.

Unless the guy hooked or sliced it, then it's not the golf course's fault.

But it the Lion's club and they do good deeds in the community!

After re reading the OP's post, the OP's insurance told him to turn the claim into the golf course, and the OP is getting the run around.

But... the Lion's club does good deeds in the community and they would never try to blow something off that they consider a pain in the butt would they?

Needless to say, I'm being sarcastic about the Lion's clue as to giving them the benifit of the doubt. Nail the Lion's club to their responsibilty if they want to run a local park with a gold course.

What the Lions club should of done was inform the OP that since everything was documented that the OP's truck was indeed hit by someone at their Golf Course, the Lion's Club insurance should handle it.

I saw this happen at a local golf course here in Ohio. Was informed that the home owner's insurance of the person who hit the ball had to take care of it. Not sure how that works, but apparently that's how it goes in Ohio.

In NY, the golf club's insurance handles anything like this. Whether it's one players ball hitting another player or damaging property off the course. No one would live near a golf course if the course wasn't paying for the damage. Players are told not to investigate if their ball did damage to a house nearby, and the home owner isn't expected to be watching their house 24/7. Don't go through your insurance company. I wouldn't be surprised if just calling your insurance company hasn't caused your vehicle to be listed as being in an accident!

I also would be careful; depending on you state insurance laws, even a No Fault Claim will stay on your insurance record here in CT (Oh, & how I know this). So when shopping around for insurance they will ask if you have had any accidents or CLAIMS in the past 36 months (it will show up); & that will affect your quotes on pricing (again here in CT). I would definitely try & get the Loin's Club to come good on this; as this incident was of no fault of your own. It's not about the $250 (well it is...) but if it affects your insurance claims record for the next 3yrs for something you did cause... I would be after them to come good on it.

Which they will. Insurance companies routinely do that. Pay the 250 and don't pass the place again.

As others have stated, I would let your insurance work it out. I always refuse to talk with the other party's insurance other than giving them the name and number of my insurance agent. I always call up my insurance and let them handle it. So far this method has worked well for me with the few incidences that I have had.

Any state where a car driver has to turn around, somehow identify which hole it came from, get onto the greens, identify the group that was playing that hole, confront them, and then get one of them to admit they were the hitter is crazy.
You'd get more "run around" than OP is getting from the Lion's Club!
