I cannot speak to that because, like everybody else, I don't have any insider information.

What I do know:

1) When in the middle of a lawsuit, until the lawsuit is settled, all attorneys advise their clients not to talk to anybody not involved with the lawsuit.

2) People in the community will talk and often talk smack assuming something is up (wrong) because nobody directly involved in the lawsuit is talking.

3) Idled employees may or may not also talk smack because they are not gainfully employed.

4) Idled employees will all at some point seek other work elsewhere because they too have bills to pay.

5) EA had a bunch of backorders and the new production facility was to help that.

6) Asking for payment upfront was to slow down demand that EA couldn't reasonably meet, but the orders kept coming in.

7) Ted had hired professional management most likely so he could focus on product design as well as marketing (making videos and such which is EA's online marketing strategy).

So yeah, based on what I do know, I doubt that Ted used customers' funds as his own money and to accuse Ted of commingling customer funds with his own funds is to claim Ted embezzled money.
Embezzling is a crime and Ted has not been accused of embezzlement. As such, I also know those people claiming he did are speculating, and frankly bearing false witness.

Maybe just venting if you happen to be out thousands of dollars and purchased due to need.

I'm not going to begrudge customers their opinion when they have nothing but questions and significant out of pocket loss.

1) Why won't the municipality grant an occupancy permit?
My suspicion would be: because they didn't actually finish the building, because they ran out of cash. And then simply found a contractor to blame.

Pure speculation on my part here, but we've all seen it before.

Per the court documents Ted received funds from the construction loan but did not pay those funds to the contractor.

"Court documents say the company requested and received more than $1 million from the construction loan to pay Neill Grading. Everything Attachments, the court documents say, did not fully pay Neill Grading and did not repay Fidelity."

It would be an interesting sales agreement that protects the buyer from delinquent taxes, liens, legal judgements, unpaid bills, past and future lawsuits .....
