Legal question on trees on property line that could cause damage...

Thanks guys.

I think I'm more than being fair offering to split the costs given the age and condition of the rental trailer.

I wouldn’t ever pay a neighbor to have their trees cut. It’s your responsibility to deal with. Especially now that it’s clear that you know it’s a potential risk.

You could then sue the arborist for dropping a tree on the trailer.
This is why I would make sure that anybody cutting trees on my land has the proper insurance. I don't know about other states, but here an arborist has a professional license.

This happened last year. Took power out to my neighbors. MI law says if my tree falls on your house, I'm not responsible. Don't exactly agree with it. I offered to pay for repairs.

I took the other tree also

Top them at 12 feet. All of them. It's cheaper (arborist) and reduces the risk of them hitting the house. Then you can deal with them as you like, when you like, or not at all

MI law doesn't have to try to be a good neighbor.
God forbid we all try to be good neighbors.

Why I feel that splitting the cost of tree removal would be the right thing to do.

That said, the law may not care what kind of neighbor you are.

When you put a mobile home trailer 15' away from a 30-40' tall tree (and a bunch of them), if you don't know it's a potential risk over time, you have your head where the sun don't shine IMO.

Reading NC law, the term "act of God" does come into play with trees falling across property lines.

On the plus side, at least you aren't my neighbor 👍

No doubt the legal system will have an answer.

When my neighbor approached me with a concern for my trees falling on his garage and I looked at them and agreed he was right I cut them on my dime. Which is what I think you should do as well. Why should the neighbor pay half to fix your problem?

Maybe it’s not the smartest plan but is he not entitled to use all of his property? Why are your trees his problem?
