Around here, way more often than not, dump trucks with 15 yards or so of dirt are not covered and I see bits of small debris blowing off them on the highway when I pass. Often wanted to call the company and complain. Haven't yet but should. Wonder how many drivers just don't bother and their company is unaware of the bad practice?

That is because nobody holds them accountable - you call them on it and they call their insurance company. Their insurance company dutifully takes all your information and then tells them they are not liable so you either take it or do something about it.

I got tired of it and was driving on a freeway when i passed a gravel truck that had a stone blow off and hit the windshield. I violated my driving rules and took a couple of pics of the side of the truck which showed that it was loaded and not tarped and the driver's door which showed the company name, DOT number, and the driver. Went through the whole rigamarole and then filed a lawsuit - not in small claims court because of the rules of evidence. Filed discovery papers on them and they called and settled for full payment plus filing fees plus a small settlement sum for the hassle - a few hundred. The windshield was worth a lot less than their lawyer.

Was it worth the time - probably not - but it did feel good.

Here in Oklahoma a uncovered load can earn you a ticket. Sand, gravel, limbs, whatever. Many properly ran dump grounds, salvage yards and other unloading sights will not allow a uncovered load to enter through their gates. Makes for a awkward problem trying to get back onto roads and find a place to tarp the load. They started cracking down on pickup loads a few years ago around here, not just big trucks. Still see some loads with issues but not as much. As time goes by hopefully there will be even fewer.

Looks like a good candidate to pull up beside, roll down the window, and call him a lazy a**hole.

I recently replaced the windshield on my wife's car due to a rock chip on the edge that spread halfway across in 30 seconds, while she was driving and looking at it. Over a thousand dollars replacement cost, and even with insurance I am out $150 deductible and the inconvenience of dropoff and pickup at the repair shop.

If a stone comes off the road on their tire and hits your vehicle, tough luck. If it falls OFF of their truck and hits your vehicle or breaks your windshield, they are indeed liable. I've collected two times by telling my insurance company the license number or truck name and all the particulars. They contact the other insurance company and "mediate" it and I get my windshield replaced. That's how it works in Ohio. The other driver, or their insurance company, does indeed pay.

You're right they can be held liable if it comes off their truck and you have some details and evidence.

I'm curious how that works in "no-fault" states such as Massachusetts and New York.

In mass I believe windshield replacement is free. Doesn’t matter how it got there.

In Virginia, you can not say a particular truck did it,,
what is stopping you from getting a plate number off a truck sitting in Hardee's while the driver is having a burger?
