I also think, where you travel should make a difference, but it doesn't legally. To tow something overweight or pushing the limits of your vehicle on the Interstate is different than being on secondary roads, in my opinion.

Particularly true in Canada with the RCMP!

Towing capacity definition has been standardized, so tow vehicle must meet minimum acceleration, braking and cooling metrics. More weight means worse braking, slower acceleration and hotter mechanicals.

I have towed my loaded equipment trailer (12,000 GVWR) on the interstate a few times with my 8,900 lb tow rated 4x4 GMC Suburban 2500 with 454 V-8.
I don't like doing it, but I keep the speed under 65 MPH, and the Suburban does fine.

Most importantly, I make certain that my trailer brakes are in perfect operating condition, set them to come on early in the braking cycle, and I DO NOT tailgate.

I use an Equal-i-zer hitch, and also try to avoid travel when the road is wet.
